Legally you need a valid social security number to be a 1099ed employee of a company. Most illegal immegrants work using false or stole/purchased socials OR they work on a cash only basis with an employer. The tax only basis with an employer is most damaging to the economy because the government isn't able to collect their cut from the business employing the individual OR the employee. This is also why companies that employ illegals get slapped with such high penalties for doing so, they're cheating the government out of money just as much as the illegal...and don't kid yourself and think they do it out of the kindness of their heart to help out the guy willing to take .50 an hour to do a shit job. They do it to save money and not get caught.

Last I heard, since 1996's reforms, An illegal alien could file taxes without a SSN, valid or bogus. They can enroll (and since '96, records say MILLIONS have) in a program that assigns them a special Tax Identification number. The IRS assigns these numbers when an applicant has no SSN, and knows that aliens are using them. The information does not go to INS because as far as the IRS is concerned, whether or not they are here legally is irrelvent; the point is that they earned income so the government will attempt to collect on it.

Unless Bush undid this reform, you do not absolutely NEED an ssn to file taxes.

Not talking about tax returns there boss...that's a form 1040. We're talking about form 1099s which are for non-taxed employment income from a company.

The tax law you are referring to is for people that are working on a legal US work visa so the US can tax people for income earned while living and working in the US. The number replaces the social security number and those people do not have to pay social security taxes, only the normal federal taxes. They do not file the normal tax return like we do, but a different form.

Ahhhh....my bad....

But that Individual Tax number...here are some articles that indicate it is used primarily by illegal aliens and not visitors with work visas...

I don't know how much you can trust em, but the impression I get is that the primary users are illegals.

What they're talking about are people filing with fake social security numbers and then assigning ITNs to those people. Actually, it's not necessarily a fake social, it's usually the social of someone who died or left the country permanently. The IRS assigns those numbers so that they can reconsile the taxes with companies that are paying their end of the taxes for the ill-gotten social, then in turn, they can also collect from the illegal. Due to the system, the IRS cannot give this info to INS because of privacy laws. So, the illegal lives in the US and pays taxes based on the number the IRS assigns to them without being deported.

Just like gamers.. people will find every possible loohole and exploit... to the point at which the systems does not function at all. Can a simpler solution be found?

Being in Arizona, I can tell you that illegal immigration is a huge problem down here and it ties up everything from social services/benefits to job placement. In the last election it was proposed that illegals should be able to get medical/health services even if they DONT have a social security card. Luckily, this did not pass otherwise it would have been a tax burden. I
n some areas of Phoenix, contractors drive around in trucks looking to pick up illegals for some cheap labor robbing citzens of jobs...

Personally, I think the idea of securing our borders with some sort of militia is a great idea. The idea of the "Minutemen" is laughable at best. There is no way they can secure the entire border.
